I acknowledge that I have 1. Voluntary Participation. I, desire to volunteer to perform the above described duties for the Midnight Mission, a California public benefit corporation (“TMM”), without compensation, and I acknowledge that I have voluntarily applied to participate in this activity organized for the purpose of helping those in need. I understand and agree that I am a volunteer, and I am not an employee of TMM. I agree to wear the issued volunteer identification at all times during this activity. 2. Conditions of Service. I acknowledge that, as a volunteer, I represent TMM before the public. I accept the responsibility of this status, and I will conduct myself in a professional manner. I will be drug-free and sober when engaging in this activity as a representative of TMM. 3. Assumption of Risk. I am not aware of any physical, mental, or other health limitation that would prevent me from safely participating in this activity. I am aware that some of the activities that I may be involved in, at, or on behalf of TMM may present certain unforeseen hazards. I further acknowledge and agree that I will utilize protective equipment and observe necessary precautions if I am required to perform any physical tasks such as lifting, bending, kneeling, etc. Despite any risks associated with my volunteer duties performed on behalf of TMM, I am voluntarily participating in these activities with full knowledge of any dangers involved and agree to accept any and all risks of injury or death, which I verify with my signature below. 4. Release. As consideration for being permitted to participate in TMM-related activities and use related facilities, I agree that I, my assignees, heirs, distributes, guardians, and legal representatives will not make a claim against, sue, or attach property on account of injury or damage resulting from negligence, carelessness, or other acts, in whatsoever manner caused, by any employee, or agent, as a result of my participation in this volunteer program. I hereby release TMM, its directors, officers, employees, agents or assignees from all liability, regardless of whether any claim is based on contractor or tort, for any special, consequential, indirect or incidental damages, including, but not limited to, lost profits, arising out of or in connection with this activity, that I and my assignees, heirs, distributes, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my participation in this volunteer program. 5. Confidentiality. In the course of my service, I may learn of, be told, or be asked to relay information of a private, confidential or privileged nature. I will not, under any circumstance, disclose private, confidential or privileged information unless explicitly directed by the designated managing supervisor with express authority to give such direction. 6. Photos. I agree to allow my image to be used in published materials and web sites that promote TMM without royalty or any other compensation if such image is captured in the course of my service. 7. Loss, Theft and Damage. I shall assume all risk of loss, theft, or damage to any of my personal property, equipment, or supplies arising from or connected with services I perform for TMM. I am over the age of eighteen and legally competent to sign this Agreement and Release From Liability or I have acquired the written consent of my parent or guardian. I understand that the terms herein are contractual and not a mere recital, this instrument is legally binding, and I have signed this document of my own free act. 8. Knowing and Voluntary Execution. I have carefully read this Agreement and Release From Liability and fully understand its contents. I am aware that this is a release of liability and sign it of my own free will.
