The Cove School will hold its 11th annual 5K Run/Walk on Saturday, September 10, 2022. The 5K race will take place on the beautiful Independence Grove Forest Preserve in Libertyville. Run or walk in the 5K and celebrate your race with refreshments at the Finish Line!

COVE SCHOOL WAIVER

I have read and agreed to the terms and conditions below.

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration of my being permitted to compete, officiate, observe, work for, or participate in any way in the 5-K run/walk scheduled for September 10, 2022 (the “EVENT”), and hereby acting for myself, my personal representatives, assigns, heirs, executors and next of kin:

I acknowledge that THE ACTIVITIES OF THE EVENT ARE VERY DANGEROUS and involve the risk of serious injury, death and/or property dam- I assume full responsibility for all such risk arising out of or related to the EVENT.
I RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE each of The Cove School, , MonTees Carpe Diem Races Co. and its affiliated corporations and charities, the host city(ies), Lake County Forest Preserves District, Lake County, Illinois, and the State of Illinois, any municipal agencies whose property and/or personnel are used or in any way assist, and all other sponsoring or co-sponsoring companies and individuals related to the EVENT, together with their officers, directors, employees, agents, shareholders, successors and assigns, premises and event inspectors, surveyors, underwriters, consultants and others who give support, first aid, medical attention, recommendations, directions or instructions or who engage in risk evaluation or loss control activities regarding the premises or EVENT (all such entities and individuals herein referred to as the “Releasees”), from and regarding all liability to me, my personal representatives, assigns, heirs, executors and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR, ON ACCOUNT OF INJURY TO MY PERSON OR PROPERTY OR RESULTING IN MY DEATH, ARISING OUT OF OR RELATED TO THE EVENT.
I agree to indemnify and hold harmless the Releasees for any loss, liability, damage or cost, including attorneys’ fees, that any one or more of the Releasees may incur arising out of or related to the EVENT and that was caused by my gross negligence or willful misconduct in connection with my participation in the EVENT.
I grant any medical director of the EVENT and his/her agents, access to all of my medical records (and physicians) as needed, and I authorize medical treatment as needed. I understand that I have the right to refuse the medical care and advice of any medical director of the EVENT and his/her agents; however, I acknowledge and agree that if my medical condition becomes such that I lose mental capacity, any medical director of the EVENT has the right to recommend and initiate treatment for me. I assume full responsibility for any and all medical expenses incurred as a result of my training for and/or participation in the EVENT, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services.
I acknowledge that any food product that may be provided by any one or more of the Releasees in connection with my participation in the EVENT may contain peanuts or may have been made near peanuts or on equipment also processing peanuts, and that I eat all such food, if any, at my own.
I agree that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement (this “Release”) extends to all acts of negligence by the Releasees and is intended to be as broad and inclusive as is permitted by Illinois law, and that if any portion of this Release is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Illinois law governs this Release.
I warrant that all of my statements made herein are true and correct, and I understand that the Releasees have relied on such statements in allowing me to participate in the event.
I grant permission to The Cove School, Inc., to use my name and likeness (including photographs, video, audio, or any other record of my participation in the EVENT) for any legitimate purpose, commercial or non-commercial, without payment to me.
I HAVE READ THIS RELEASE, I FULLY UNDERSTAND ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING I HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, GUARANTEE, REPRESENTATION OR WARRANTY BEING MADE TO ME, AND I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
I am at least 18 years old and I will be the participant in the event. Or I am the parent or legal guardian of a participant in the EVENT, I hereby grant permission for the participant to participate in the EVENT, and I am signing this. Release for myself and for the participant.
